Objective

Upon completion of this lesson, the student will demonstrate comprehensive knowledge of commercial pilot helicopter certification requirements, privileges, limitations, and currency regulations under 14 CFR Parts 61, 68, and 91. The student will correctly apply these requirements to realistic flight scenarios and identify risk management considerations related to pilot proficiency and aircraft familiarity. This lesson supports FAA-S-ACS-16 Area of Operation I, Task A (CH.I.A).

CH.I.A.K1: Certification Requirements, Recent Flight Experience, and Recordkeeping

Commercial Pilot Certificate Requirements (14 CFR §61.123, §61.129)

The commercial helicopter pilot certificate represents professional-level competency. Requirements include:

Currency Requirements (14 CFR §61.57)

Unlike private pilots who must only meet basic currency to carry passengers, commercial pilots must maintain currency to exercise commercial privileges:

Analogy: Think of currency like a gym membership. Having the card (certificate) doesn’t mean you can lift what you used to—you need recent workouts (currency) to maintain capability. The commercial certificate raises the bar on what “in shape” means.

Recordkeeping Requirements (14 CFR §61.51)

Commercial pilots must maintain meticulous logbooks because these records document qualifications for employment, insurance, and FAA compliance:

Electronic Logging: While electronic logbooks (ForeFlight, MyFlightbook) are acceptable, maintain backups. Some operators require specific paper logbook formats for insurance or operational documentation.

CH.I.A.K2: Privileges and Limitations

Commercial Pilot Privileges (14 CFR §61.133)

A commercial helicopter pilot may:

  1. Act as PIC for compensation or hire in operations requiring commercial certificate or airline transport pilot certificate, provided pilot meets §61.57 currency and aircraft certification requirements
  2. Act as PIC carrying persons or property for compensation or hire if qualified per Part 61 and operation is authorized under Parts 91, 133, 135, or 137
  3. Act as PIC in operations incidental to business where flight is only incidental to business and not for-hire flight operations (common carriage)

Key Commercial Operations Categories:

Commercial Pilot Limitations (14 CFR §61.133(b))

A commercial pilot may NOT:

  1. Act as PIC in passenger-carrying operations for compensation or hire with less than 300 hours unless holding an instrument rating and meeting night flying requirements (rare limitation—most commercial pilots exceed 300 hours through §61.129 training)

  2. Engage in operations requiring ATP certificate:

    • Part 121 scheduled airline operations
    • Part 135 operations requiring ATP (typically helicopters >9 passengers or complex IFR)
  3. Conduct common carriage operations without proper operating certificate:

    • Cannot “hold out” charter services without Part 135 certificate
    • “Holding out” includes advertising, reputation, previous pattern of service
  4. Act as PIC beyond limitations of medical certificate or BasicMed (covered in K3)

Critical Distinction—Private Carriage vs. Common Carriage:

CH.I.A.K3: Medical Certificates—Class, Expiration, Privileges, Temporary Disqualifications

Medical Certificate Requirements (14 CFR §61.23)

Commercial helicopter operations require appropriate medical certification. Unlike private operations where BasicMed may apply, commercial operations have specific requirements:

Critical Timing: After second-class expiration period, the medical certificate reverts to third-class privileges. A commercial pilot with expired second-class medical may only exercise private pilot privileges until renewed.

Medical Certificate Denials and Appeals:

If medical certificate is denied, pilot may:

  1. Request reconsideration from FAA with additional medical information
  2. Apply for special issuance under §67.401 (common for conditions like diabetes, ADHD medications, cardiac issues)
  3. Obtain Authorization for Special Issuance (ASI) allowing certificate issuance with conditions

Temporary Disqualifications (14 CFR §61.53)

A pilot may NOT act as PIC or required crewmember when:

  1. Known medical deficiency: Any physical or mental condition that would make pilot unable to safely operate aircraft
  2. Specific disqualifying conditions (14 CFR Part 67):
    • Acute infections (influenza, COVID-19 with symptoms)
    • Medications with disqualifying side effects (sedating antihistamines, opioids, benzodiazepines)
    • Alcohol: 8 hours “bottle to throttle,” BAC <0.04%, no hangover effects
    • Drugs: Any illegal drug use, any medication affecting safety
  3. Recent medical procedures: Even minor surgeries or dental procedures may temporarily disqualify
  4. Emotional/psychological factors: Severe stress, grief, anger, depression

IMSAFE Checklist Application:

Critical Regulation—§61.53(a): “No person who holds a medical certificate issued under part 67 of this chapter may act as pilot in command, or in any other capacity as a required pilot flight crewmember, while that person knows or has reason to know of any medical condition that would make the person unable to meet the requirements for the medical certificate necessary for the pilot operation.”

This is self-grounding authority and responsibility. Even with valid medical, pilot must not fly if temporarily impaired.

CH.I.A.K4: Documents Required to Exercise Commercial Pilot Privileges

Personal Documents—Three Levels:

Level 1: Documents Required in Personal Possession (§61.3)

To exercise commercial pilot privileges, pilot must have:

  1. Pilot certificate: Physical commercial pilot certificate or temporary certificate with photo ID

    • Must be commercial pilot helicopter certificate
    • Category and class ratings must match aircraft
    • Type rating if aircraft requires (e.g., turbine helicopters >7,000 lbs GTOW)
  2. Government-issued photo ID:

    • Driver’s license, passport, military ID
    • Must be current and valid
    • Name must match pilot certificate
  3. Medical certificate or BasicMed documents:

    • Second-class medical (for commercial operations)
    • First-class acceptable for commercial operations
    • Third-class or BasicMed: private privileges only
    • Plastic card OR printout from MedXPress if recent issuance
  4. If applicable:

    • Complex/high-performance endorsements (unusual for helicopters)
    • Flight review endorsement visible in logbook
    • Part 135/133 company ID and operational authorizations

Level 2: Documents Required Accessible During Flight (§91.203)

Aircraft documents required aboard helicopter during operations:

Mnemonic: ARROW (note: Radio license removed for domestic ops)

Level 3: Documents Not Required in Aircraft but Must Be Available:

Commercial Operation Specifics:

For commercial operations (compensation or hire), 100-hour inspection is required unless:

100-Hour Inspection Tolerance: May exceed by up to 10 hours if flown to location where inspection can be performed, but excess time counts against next 100-hour interval (e.g., inspection at 108 hours means next due at 200 hours, not 208 hours).

Special Flight Permits (Ferry Permits): If aircraft is unairworthy but capable of safe flight, special flight permit may be issued under §21.197 to fly to maintenance facility. Commercial pilots often ferry aircraft for this purpose.

CH.I.A.K5: Part 68 BasicMed Privileges and Limitations

BasicMed Authorization (14 CFR §61.113(i) and §68)

BasicMed, enacted in 2017, provides alternative to third-class medical certification. However, BasicMed is NOT valid for commercial operations.

BasicMed Requirements:

  1. Eligibility:

    • Hold valid U.S. driver’s license
    • Have held medical certificate at some point after July 14, 2006 (never denied, suspended, revoked, or withdrawn)
    • Complete medical education course every 24 calendar months
    • Undergo physical examination by state-licensed physician every 48 months
    • Complete Comprehensive Medical Examination Checklist (CMEC)
  2. BasicMed Privileges:

    • Act as PIC under VFR or IFR
    • Carry up to 5 passengers
    • Fly aircraft up to 6,000 pounds MTOW (most light helicopters qualify: R22 1,370 lbs, R44 2,500 lbs, Bell 206B3 3,350 lbs)
    • Fly at or below 18,000 feet MSL
    • Fly not faster than 250 KIAS
  3. BasicMed Limitations—Critical for Commercial Pilots:

    • Cannot operate for compensation or hire
    • Cannot operate under Part 119, 121, 125, 135, or 137
    • Cannot operate outside United States unless foreign country accepts BasicMed (currently Bahamas, Mexico—limited acceptance)
    • Cannot operate aircraft requiring ATP certificate
    • Cannot serve as required pilot flightcrew member (SIC) in operations requiring two pilots

Application to Commercial Pilots:

A commercial pilot operating under BasicMed is limited to private pilot privileges only. This means:

Valid Commercial BasicMed Scenario: Commercial pilot flying personal helicopter under BasicMed for personal transportation only—essentially exercising private pilot privileges despite holding commercial certificate.

Regulatory Clarification—§61.113(i): “A person who holds a current and valid U.S. driver’s license, has been found eligible for the issuance of at least a third-class airman medical certificate at the time of his or her most recent application, and has satisfied the requirements of §68.9… may act as pilot in command of an aircraft… [within BasicMed limitations].” Note absence of commercial operations authorization.

Critical Teaching Point: Many commercial pilots mistakenly believe BasicMed allows commercial operations because they hold commercial certificate. This is FALSE. Operating commercially under BasicMed violates §61.133(c) medical certificate requirements and may result in certificate action.

CH.I.A.R1: Proficiency versus Currency (Risk Management)

Defining the Critical Distinction:

Risk Management Principle: Currency is necessary but insufficient for safety. Legal does not equal safe.

Real-World Risk Scenarios:

  1. Scenario—Marginally Current Pilot:

    • Commercial pilot flew 3 times in last 85 days (barely current)
    • Each flight was routine local pattern work in calm winds
    • Customer requests mountain cross-country with confined area landing
    • Risk: Pilot is current but not proficient for mission complexity
  2. Scenario—Returning to Flying:

    • Commercial pilot took 4-month break for personal reasons
    • Completes 3 takeoffs/landings to restore currency
    • Immediately accepts commercial photo flight over congested area
    • Risk: Restored currency ≠ restored proficiency; needs skill rebuilding
  3. Scenario—Aircraft Type Transition:

    • Commercial pilot has 500 hours in R22
    • Transitions to R44 with 3-hour checkout (meets insurance minimums)
    • Customer requests long cross-country day after checkout
    • Risk: Current in type but not proficient; different power management, inertia, settling tendency

Proficiency Maintenance Strategies for Commercial Pilots:

Commercial Pilot Professional Standard: Establish personal minimums above regulatory minimums. Example: “I won’t accept commercial flight unless I’ve flown within last 14 days and practiced type of operation within last 30 days.”

Risk Management Application: Before accepting any commercial flight, conduct honest self-assessment:

  1. When did I last fly this aircraft type?
  2. When did I last fly in similar conditions?
  3. When did I last perform maneuvers required for this mission?
  4. Am I truly proficient or merely current?

Decision-Making Framework: If you question your proficiency, schedule refresher training before accepting commercial work. The reputational and legal consequences of an incident far exceed cost of recurrent training.

CH.I.A.R2: Flying Unfamiliar Helicopter or Operating with Unfamiliar Flight Display Systems and Avionics (Risk Management)

Make and Model Differences—Helicopters Are NOT All the Same

Unlike relatively standardized automobile driving, each helicopter model has unique flight characteristics, systems, and operational considerations. Commercial pilots frequently transition between aircraft types, creating significant risk exposure.

Critical Helicopter Variations:

  1. Rotor System Design:

    • Semi-rigid teetering (R22, R44, Bell 206): Mast bumping risk in low-G conditions, different flare technique
    • Fully articulated (Bell 407, UH-1): More stable platform, different cyclic response
    • Rigid/bearingless (EC135, MD500): Rapid control response, different autorotation characteristics
  2. Power Management:

    • Piston engines (R22, R44): Carb heat considerations, mixture management, altitude limitations
    • Turbine engines (Bell 206, AS350): Torque/temp limitations, hot start risks, altitude capability
    • Different power margins: Some helicopters have excess power (AS350), others marginal (R22 high-altitude)
  3. Tail Rotor Configurations:

    • Conventional tail rotor: Standard LTE considerations
    • Fenestron (EC130, EC135): Different yaw control feel, reduced LTE risk

    • Understand unique emergency procedures
    • Learn system differences (hydraulics, electrical, fuel)
  3. Build proficiency before commercial operations:

    • Complete multiple supervised flights
    • Practice all normal and emergency procedures
    • Fly in varied conditions before accepting commercial work
  4. Respect aircraft-specific hazards:

    • R22: Mast bumping, throttle management in autos
    • R44: Higher inertia, different flare timing, more stable but heavier controls
    • Turbines: Hot starts, hung starts, compressor stalls, FOD awareness

Robinson R22/R44 Special Emphasis: These aircraft require SFAR 73 awareness training. While not required for certificated pilots, commercial pilots should complete Robinson Safety Course covering:

Avionics and Flight Display Systems Risk Management:

Modern helicopters increasingly incorporate advanced avionics unfamiliar to pilots trained on analog instruments. Risk areas include:

  1. Glass Cockpit Transition (G500H, Garmin G1000H, Aspen):

    • Information overload: too much data presented simultaneously
    • Mode confusion: misunderstanding automation state
    • Buttonology: distraction during critical flight phases

FAA Guidance: While no specific regulation requires transition training for commercial pilots (unlike ATP type ratings), AC 61-65H emphasizes “differences training” for pilots operating aircraft with different equipment or systems. Professional commercial pilots should seek formal differences training rather than minimum legal compliance.

Ryan Dale perspective: “Every helicopter is a different animal. Treating a Bell 206 like an R22 can kill you. Treat every new type rating like you’re learning to fly again—because in many ways, you are.”

CH.I.A.S1: Apply Requirements to Act as PIC Under VFR in Given Scenarios

This skill element requires applying all knowledge from K1-K5 to realistic commercial pilot scenarios. The evaluator will present situations requiring the pilot to determine legal PIC qualification.

Scenario Analysis Framework:

When evaluating PIC qualification, systematically check:

  1. Certificate: Do I hold appropriate commercial pilot helicopter certificate?
  2. Ratings: Do my category/class ratings match aircraft?
  3. Type Rating: If aircraft >7,000 lbs or requires type rating, do I have it?
  4. Medical: Is my second-class medical current for commercial operations?
  5. Currency: Have I met §61.57 takeoff/landing requirements in this aircraft?
  6. Documents: Do I have required personal documents and is aircraft airworthy?
  7. Proficiency: Am I proficient for this specific operation?
  8. Regulations: Does the specific operation comply with Part 91/133/135 requirements?
  9. Self-Assessment: Am I physically and mentally fit to fly (§61.53)?

Example Scenarios for Training:

Scenario 1: You hold a commercial pilot helicopter certificate with instrument rating. Your second-class medical was issued April 15, 2024 (you are 38 years old). Today is May 20, 2025. A local construction company calls requesting a photo survey flight tomorrow. You last flew on March 10, 2025. Are you legal to accept this flight?

Analysis:

Scenario 2: You’re a commercial pilot current in R22. Your friend owns an R44 and offers to let you fly it for a real estate photography job paying $300. You’ve never flown R44. Friend says “it’s basically the same, just bigger.” Are you legal? Should you accept?

You can exceed by 10 hours to reach inspection location, but overage counts against next inspection. So if you go 8 hours over, next inspection due in 92 hours, not 100.”

  13. Present CH.I.A.K5 (BasicMed): Explain BasicMed thoroughly since many pilots ask about it. Emphasize clearly: “BasicMed is wonderful for private pilots, but it does NOT authorize commercial operations—period. If you’re on BasicMed, you cannot accept compensation for flying, cannot instruct for pay, cannot do any commercial work. You must hold second-class medical for any commercial operation.”

  14. Present CH.I.A.R1 (Proficiency vs. Currency): “Here’s where good commercial pilots separate from marginal ones: self-awareness. Currency is FAA minimum. Proficiency is personal capability. If you’re barely current—say you flew 3 times in 89 days—are you really sharp enough to accept commercial photo flight over congested area? Honest answer is probably no. Good commercial pilots build proficiency margin beyond currency minimums.”

  15. Present CH.I.A.R2 (Unfamiliar Aircraft/Avionics): Discuss specific helicopter type differences. Show POH pages from different helicopters illustrating different emergency procedures. “Robinson requires low-G awareness. Bell 206 has hydraulic failure considerations. Turbines have hot start procedures. You cannot treat them as interchangeable. Get proper checkout, build proficiency, respect differences.”

  16. Demonstrate scenario analysis method: “When evaluator asks ‘Are you legal to do this flight?’, use systematic framework: Certificate-Rating-Medical-Currency-Documents-Proficiency-Regulations-Fitness. Check each element. If ANY fails, you’re not legal. Let’s practice this method.”

  17. Present Scenario 1 and model analysis: Read scenario aloud. “Commercial certificate? Yes. Second-class medical current? Let me calculate—issued April 2024, I’m 38, so valid 12 months until April 2025. Today is May 2025, so NO—expired last month. Currency? I haven’t flown since March, so NO—no landings in 90 days. Two failures. Decision: Not legal to accept commercial flight. I need new medical AND need to get current.”

  18. Guide student through Scenarios 2-3: Present each scenario, have student analyze using framework, provide feedback and correction. “Good catch on the currency issue. What about proficiency? Zero time in R44 means even if you got legal with 3 landings, would you be safe? Insurance issue? What if you bent it?”

  19. Present progressively complex scenarios: Increase difficulty with scenarios involving multiple factors: BasicMed + commercial operations, medical class expiration timing, night currency for passenger operations, 300-hour limitation with/without instrument rating.

  20. Conduct oral quiz: Rapidly quiz regulatory knowledge: “What regulation covers commercial pilot privileges? §61.133. How long is second-class medical valid under age 40? 12 calendar months. Can BasicMed be used for commercial operations? No. How many hours required for commercial certificate? 150 total, 100 PIC. When does 100-hour inspection apply? When aircraft used for compensation or hire.”

  21. Review common mistakes: “Here are the gotchas that bust commercial pilots: thinking BasicMed allows commercial operations, not tracking calendar month vs. 30-day differences for medicals, assuming checkout equals proficiency, operating Part 91 but thinking Part 135 rules apply, logging PIC time incorrectly for insurance.”

  22. Assign homework: “Before next lesson, review your logbook and calculate your currency status for every aircraft you’ve flown. Verify your medical expiration date. Write out three scenarios like we practiced today where a pilot would NOT be legal PIC, and explain why. Bring these to next session.”

  23. Verify understanding: Ask student to teach back one key concept: “Explain to me like I’m a new pilot: what’s the difference between proficiency and currency and why does it matter?” Assess comprehension and clarity.

  24. Connect to next lesson: “We’ve covered pilot qualifications. Next lesson we’ll cover aircraft airworthiness—what makes the aircraft legal to fly. These work together: you must be qualified AND aircraft must be airworthy. Both required for legal operation.”

  25. Closeout and schedule: Confirm student met completion standards (see Section 7). Answer remaining questions. Schedule next lesson. “Excellent work today. You demonstrated solid understanding of commercial pilot privileges and limitations. Keep that systematic analysis framework—you’ll use it on every flight you take as commercial pilot.”

Student Actions

  1. Active listening and note-taking: Student takes organized notes on certification requirements, privileges, limitations, medical requirements, and document requirements throughout presentation.

  2. Asks clarifying questions: Student seeks clarification on complex regulations (e.g., “If my medical expires on January 15th, do I have until January 31st or January 15th to fly commercially?”).

  3. Reviews personal documents: Student examines own pilot certificate, medical certificate, and logbook to verify currency status and understand expiration dates.

  4. Calculates currency dates: Student practices computing takeoff/landing currency from logbook entries, calculating 90-day windows, and determining medical expiration dates using calendar month rules.

Completion Standards

The lesson is complete when the student demonstrates comprehensive knowledge and application ability for ACS Task CH.I.A—Pilot Qualifications. Specific completion standards:

Knowledge Requirements (CH.I.A.K1-K5):

  1. Correctly states commercial pilot certification requirements from 14 CFR §61.123 and §61.129(c) including:

    • Minimum age 18 years
    • 150 hours total time with specific breakdown (100 hours PIC, 50 in helicopters, etc.)
    • Required training elements (5 hours instrument, cross-country day/night, 3 hours within 2 calendar months)
    • Aeronautical knowledge and practical test requirements
  2. Accurately explains currency requirements per 14 CFR §61.57:

    • 3 takeoffs and 3 landings within preceding 90 days for passenger-carrying operations
    • Night currency: 3 full-stop landings between 1 hour after sunset and 1 hour before sunrise
    • Flight review requirements (every 24 calendar months)
    • Instrument currency if applicable (6 approaches, holding, tracking within 6 calendar months)
  3. Describes logbook requirements per 14 CFR §61.51:

Evaluator Note: Student must demonstrate comprehensive understanding of pilot qualifications meeting standards of FAA-S-ACS-16 Task CH.I.A. Any gaps in knowledge of certification requirements, privileges/limitations, medical requirements, or document requirements must be remediated before proceeding to practical test preparation. The systematic scenario analysis framework should become habitual decision-making tool for all future commercial operations.
